Healthcare directives come up constantly around here, and they’re the document type people are most often confused about, usually in a way that costs them an appointment. Pennsylvania’s requirements for a healthcare power of attorney and a living will are not the same as for a financial power of attorney. A healthcare directive has to be signed and dated by you in the presence of two witnesses, both at least eighteen, and the statute does not require a notary at all.

So why call me? Because plenty of hospitals, care facilities, and out-of-state institutions ask for a notarized one regardless of what the statute requires, and a directive that is both properly witnessed and notarized satisfies everyone without an argument at the worst possible moment. There is no downside to having both. There is a real downside to turning up at an admissions desk with a document that is missing whichever one that particular institution wanted.

The practical upshot: if healthcare directives are in your stack, arrange two witnesses to be present when I arrive, adults who aren’t named as your agent. I can notarize your signature, but I can’t be one of your two witnesses, and I can’t fix a missing witness after the fact. A financial power of attorney signed the same afternoon needs two witnesses as well, plus the notarization, so the same two people usually cover the whole sitting.
